Aan de leden van de Tweede Kamer der Staten-Generaal,
Wij, burgers van Nederland, verzoeken u dringend om een eenduidige en duidelijke Nederlandse lijn te trekken tegen de ProtectEU-veiligheidsstrategie.
Waar Nederland mensenrechten en het vertrouwen tussen overheid en burger als fundamenten van veiligheid ziet, kiest ProtectEU de tegenovergestelde koers. Niet vertrouwen maar wantrouwen wordt het uitgangspunt. Het scannen van privédata, massale ongerichte dataverzameling en algemene traceerbaarheid behandelt burgers als verdachten in plaats van als bondgenoten.
Stelt u zich dit voor in ons land: een door de staat verplichte scanner op uw telefoon leest uw WhatsApp-gesprekken met familie. Inloggen op elke website vereist dat u uw overheidsidentiteit afgeeft. Camera’s op stations volgen uw hele reis en uploaden die naar politiedatabanken. Technologiebedrijven leggen vast waar u slaapt, waar u werkt, wie u liefhebt en wat u gelooft. Geautomatiseerde dataverzameling reduceert een mensenleven tot een dataprofiel.
Als verdenking de norm wordt, verandert onze cultuur. Artsen, advocaten, journalisten en leraren verschuiven van bondgenoten naar potentiële informanten. Burgers doen minder aangifte en gaan zichzelf censureren. De Nederlandse - en Europese - veiligheidsfilosofie, gebaseerd op wederzijds vertrouwen en respect, slaat om. In onze traditie is vertrouwen een kernwaarde; schrijft men wantrouwen in beleid, dan worden achterdocht en angst de fundamenten van de samenleving.
U kunt hier iets aan doen.
Onze voorouders bouwden Nederland op vrijheid en veiligheid, gegrondvest op vertrouwen, juist omdat wij de gevolgen van absolutistisch beleid kennen. In de moderne wereld worden die kernwaarden waardevoller én schaarser.
Wij roepen alle leden van de Kamer op om zich verenigd uit te spreken tegen de ProtectEU-strategie. Nu is het Nederlandse standpunt versnipperd; juist via die versnippering sluipt wantrouwen het beleid in. Eenheid is hoe een klein land een Europese norm kan bepalen.
Wij vragen u, als bewakers van de Grondwet, om met één stem in Brussel te laten horen dat vertrouwen en respect het fundament van de Europese samenleving vormen.
Ten eerste: garandeer het recht op encryptie.
Een vertrouwenssamenleving vergt privacy. Mensen moeten kunnen denken, spreken en leren zonder angst voor gevolgen of voorafgaande toestemming. Door het recht op encryptie wettelijk te borgen, behouden burgers blijvend de ruimte om hun overheid vreedzaam en rechtmatig te controleren en te bekritiseren. Encryptie maakt de vrijheid van gedachte en communicatie praktisch afdwingbaar.
Ten tweede: neem een definitieve positie in ten aanzien van ProtectEU.
ProtectEU ondergraaft het fundament van onze Grondwet. Privacy, vertrouwen en de verhouding tussen overheid en burger lijden wanneer wantrouwen in beleid wordt vastgelegd. Wij vragen de Kamer om eensgezind en duidelijk stelling te nemen tegen de huidige vorm van de ProtectEU-strategie, en iedere maatregel af te wijzen die het grondrecht op privacy en het vertrouwensbeginsel aantast.
De keuzes die voor u liggen gaan niet alleen over technologie, maar over wat voor land wij blijven. Door het recht op encryptie te waarborgen en onverkort op te komen voor burgerrechten kan Nederland laten zien dat vrijheid en veiligheid elkaar niet beconcurreren, maar elkaar versterken.

ProtectEU is a plan by the European Union that claims to be intended to protect us. But what it really does is the opposite.

The EU gives the government and police access to your chats, emails, apps, photos, devices, even if they are currently protected by end-to-end encryption.

Increased collection and linking of data such as fingerprints, DNA, license plates, facial images, and police files between EU countries.
Tracked on the road and during travel.
The European Union wants to be able to track you more. Your travels, movements, even via private flights, boats, and smart license plate scans along the road.
ProtectEU affects everyone. The plan makes it so that your messages, photos, and location are no longer truly private, and even wants to break encryption... The very security that protects us from hackers and criminals. If something goes wrong, the data of millions of people will be exposed. You don't have to do anything wrong to be followed according to ProtectEU, just existing is enough. That's why we say: stop the plans for Protect EU.

ProtectEU sounds like protection, but in reality it’s about control. Behind nice words about safety lies a plan that looks ever deeper into our personal lives. Our conversations, our movements, our memories, absolutely nothing remains truly our own. This is not how Europe is supposed to work.

Chat Control off the table again, or not? ProtectEU keeps coming back.
The controversial EU plans to scan private messages, better known as Chat Control, ProtectEU or the CSA regulation have once again stalled.
Due to the German opposition vote, there is once again no majority in the European Council, causing the planned vote on October 14 to be canceled.
The blockade brings relief, but the fight is far from over.
тАЬThis is not a victory, it’s a delay,тАЭ says Bjorn Overbeek of Vallem. тАЬChat Control is a classic zombie proposal: it disappears from view for a while, but keeps coming back in a different form.тАЭ
A Proposal that Refuses to Die
Since 2022, the European Commission has been trying to implement legislation requiring chat service providers to scan messages for potentially illegal content. Where earlier versions spoke of large-scale server scans, the plan was later adjusted to so-called client-side scanning, scrutinizing messages even before they are encrypted.
In some drafts, there is even talk of voluntary detection by providers, but the goal remains the same: access to personal communication.
According to critics, this poses a direct threat to the security of citizens and businesses.

Time for a Definitive тАЬNoтАЭ
Although Chat Control in its current form has been blocked again, the proposal officially remains on the table. New compromises or versions may be submitted again in the coming months.
Vallem therefore calls on citizens, businesses, and experts to continue to speak out against the plans.
тАЬWe cannot continue to rely on chance or political blockades,тАЭ says Vallem. тАЬAs long as this dossier is alive, the risk remains that it will still get through via a backdoor.тАЭ
We advocate for clear boundaries: no encryption backdoors, no scanning software on devices, no Chat Control, no ProtectEU.
